What is possible option for custody if parents are not legally marry?

We did have a wedding day but we never do anything to get the marry certificate. I wonder how custody would be determine?? My baby is 4 months old, and he have been gone for 2 months. Never hear anything from him. I'm filing child support, but still wonder about custody.What is possible option for custody if parents are not legally marry?
Right now you have physical custody of your child since he/she is in your physical custody, yet it's not on paper through the court system. You will have to file paperwork with the state for legal custody. You might as well file it with the support paperwork and they usually don't charge you for filing twice since it's the same court date/hearing. You child is technically ';floating';. Neither parent has custody in the eyes of the state since nothing was filed. He has just as much right to your child as you do until you file paperwork and go to court. If he poses a problem about wanting to take your child before you go to court, i would call the police. It's your word against his but usually they go for the mother and where the child has been residing. You will have to have him served with papers in order for the court filings to be fare and give him every opportunity to show up for court. Good luck. It makes no difference if you and your ex where married. He has just as much legal responsiblity for his child as you do.


You current have legal custody of your child and will continue to have custody, he may apply to the courts for visitation which may start of as every other day until your child is older then he can apply for 50/50 care, however until the day he actually applies for some kind of custody of your child there is nothing you can do as you are legally the child custodian.


The courts do not care if you were married or not all they care is what is in the child best interest, he will need to explain why he has not been involved before now
if he wants the baby all of a sudden he will only get 15-25%


since he hasn't been their for the baby!

i think the mother would have custody and the father could file. i'm not completely sure though
