I live in Georgia and I have a son who is five years old attending Kindergarten. My son has some behavior issues but he is not slow. The school wants to put him in Special Ed because he refuses to talk to them; he talks to me all the time at home, in complete sentences. What are my rights as a parent in this situation? Do I have to go with what the school thinks is best for him or do I have options?

-Try to work with the special Ed staff as much as possible instead of against them. They likely want to develop a I.E.P. (individualized education plan) for your child, which can be a good thing, especially for combating unwanted behavior. My guess is that they don't want to pull him from the classroom, but rather just want to assign him extra resources that he can't qualify unless he is admitted into an IEP program. In most cases, special ed students remain in the classroom as much as possible, but are simply provided additional supportive measures and resources (such as aides) that can really be a huge benefit to your child!
As a parent you have a right to be present at all IEP meetings
you have a right to provide input and review all tests
you have a right to share your opinions and suggest alternatives
However, the school can sign off on an IEP without you.
I would advise working with the special Ed staff as much as possible, they want to see your child succeed as much as you do!
